Employees
This section of the PilchConnect website contains information about:
- the legal difference between an employee, an independent contractor and a volunteer;
- the legal rights and obligations of not-for-profit community organisation employers; and
- the legal rights and obligations of not-for-profit community organisation employees.
The PilchConnect website is continually developing. We are updating and adding to the information as we continue to help Victorian not-for-profits with their legal issues.
What is the definition of an employee?
PilchConnect has developed a Guide to help Victorian not-for-profit community organisations understand different kinds of working relationships - including that of employee/employer. It is important for your community organisation to know when you are 'employing' a person, because different legal entitlements and obligations apply, depending on whether the worker is regarded as an 'employee', an 'independent contractor' or a 'volunteer'.
The Guide outlines:
-
the importance of correctly classifying different working relationships;
-
the basic legal differences between employees, independent contractors and volunteers; and
-
an overview of some of the main legal obligations an organisation owes to its employees, independent contractors and volunteers.
