The use of Caveats and Equitable Trusts in cases of Elder Abuse
This SRLC training session explores the use of caveats to assist clients at risk of or experiencing elder abuse, including reasons for lodging a caveat, how to lodge a caveat and how to remove a caveat. The topic of trusts, with a focus on establishing a client’s equitable interest in a property will also be explored.

Presenter
Richard Wilson, Barrister. Richard has a strong interest in Human Rights and the Victorian Charter, and has accepted briefs from the HPLC in Guardianship and Administration areas and from the Tenant’s Union of Victoria in eviction matters. He was counsel representing the applicants in Metro West v Sudi (Residential Tenancies) [2009] VCAT 2025 (9 October 2009) concerning the importance to the protection of human rights of “public authorities”, and their definition, under s4(1)-(5) and s38 of the Charter.
